Terms and Conditions of Sale

Preamble

These Terms and Conditions of Sale (hereinafter the “Terms”) are drafted in the French language.

In the event of a translation, only the French version shall prevail in case of differences in interpretation.

They govern the contractual relationship between:

Exempt from registration with the Registre du Commerce et des Sociétés (RCS) under the legal provisions applicable to micro-entrepreneurs providing services.

(hereinafter the “Publisher”)

and

any natural person acting as a consumer (hereinafter the “Customer”).

Article 1 — Purpose

These Terms define the conditions governing the sale of online training courses offered by the Publisher.

Any order implies full and unconditional acceptance of these Terms.

Article 2 — Legal Capacity

The Customer declares that they are an adult and have the legal capacity required to enter into this contract.

Article 3 — Description of the Service

The service consists of access to one or more online courses related to the observation and understanding of the night sky.

The service includes digital access to educational content such as:

  • videos
  • written materials
  • visual resources

The service:

  • does not constitute an official diploma
  • does not provide any state-recognized certification
  • does not constitute a regulated training program

The content is provided for informational and educational purposes only.

Service Evolutions

The Publisher reserves the right to modify, improve, or update the content, interface, features, or technical modalities of the service at any time, provided that such modifications do not alter the main purpose of the contract.

Such changes shall not constitute grounds for termination or refund, provided that access to the service as described at the time of purchase remains available.

Article 4 — Prices

Prices are expressed in euros (€).

VAT not applicable – Article 293 B of the French General Tax Code.

The applicable price is the price displayed at the time of the order.

Article 5 — Payment

Payment is made exclusively through the secure Stripe payment platform.

Payment is due in full at the time of purchase.

Access is granted immediately after payment confirmation.

Article 6 — Account Creation

A personal and individual user account is automatically created.

Account access is:

  • strictly personal
  • non-transferable

Account access is limited to a maximum of two (2) simultaneous active sessions.

Any attempt to bypass this limitation may result in immediate suspension.

Article 7 — Access Duration

Access to the course is granted as long as the platform remains active.

In the event of permanent discontinuation of the service:

  • a 30-day notice period will apply
  • no compensation shall be owed

Article 8 — Right of Withdrawal

In accordance with Article L.221-28 of the French Consumer Code:

The Customer expressly acknowledges:

  • that they request immediate execution of the service upon validation of the order
  • that they therefore waive their statutory right of withdrawal

Mandatory text displayed during payment:

“I request immediate access to the digital content and expressly acknowledge that I waive my legal right of withdrawal in accordance with Article L.221-28 of the French Consumer Code.”

No refund will be granted under the right of withdrawal.

Article 9 — Service Unavailability

The service may be temporarily interrupted due to maintenance or technical incidents.

If a total service outage attributable to the service, and not to the Customer’s equipment or connection, exceeds 72 consecutive hours:

  • an equivalent extension of access will be granted.

If the outage exceeds 7 consecutive days:

  • the Customer may request contract termination, provided that less than 50% of the content has been consumed.

Any extension granted constitutes a compensatory measure and does not alter the nature of the originally granted access.

Article 10 — Technical Requirements

Access requires:

  • a stable internet connection
  • a recent web browser
  • compatible equipment

Certain exercises may require the use of third-party sky-mapping software, presented for illustrative purposes (example: Stellarium desktop version).

This software is published by an independent third party.
It is not provided, hosted, or controlled by the Publisher.

The Publisher does not guarantee:

  • compatibility with the Customer’s equipment
  • availability of the software
  • its free access
  • its long-term maintenance

The Customer remains free to use any equivalent software of their choice.

The Publisher shall not be held responsible for malfunctions, incompatibilities, modifications, or removal of this software by its publisher.

Article 11 — Intellectual Property

All content is protected by copyright law.

The Customer is granted a strictly personal, non-exclusive, and non-transferable right of use.

The following are prohibited:

  • reproduction
  • distribution
  • account sharing
  • resale
  • making the content available to third parties

Article 12 — Third-Party Content

Certain images or resources may originate from third-party organizations (NASA, ESA, ESO, Stellarium, Pexels, etc.).

These organizations are neither partners nor affiliates of the service.

Their use complies with the applicable licenses.

Article 13 — Suspension

In the event of a serious violation (fraudulent sharing, piracy, illegal reproduction):

  • immediate suspension may occur.

For minor violations:

  • a prior warning may be issued.

Article 14 — No Guarantee of Results

The service constitutes an educational training program.

There is no guarantee of educational results.

The course content is provided for informational and educational purposes only.

The Publisher does not guarantee:

  • any specific result
  • learning progression
  • acquisition of particular skills

Understanding, assimilation, and practical application of the content depend entirely on the Customer’s personal involvement.

No official certification or institutional recognition is issued.

Article 15 — No Personalized Advice

The content provided does not constitute individualized professional advice or personalized guidance.

Article 16 — Content Updates

The Publisher may modify, update, or improve the content at any time, provided that the main purpose of the service is not altered.

Article 17 — Limitation of Liability

The Publisher shall not be held liable for indirect, incidental, or consequential damages suffered by the Customer, including but not limited to:

  • loss of data
  • loss of income
  • loss of business
  • loss of opportunity
  • commercial harm
  • reputational damage
  • interruption of activity
  • any other economic loss resulting from the use or inability to use the service

In any event, the total liability of the Publisher, for all causes combined, shall be strictly limited to the amount actually paid by the Customer for the relevant order.

This limitation shall not apply in cases of gross negligence or intentional misconduct.

Article 18 — Force Majeure

The Publisher shall not be held liable in the event of unforeseeable and external events, including but not limited to:

  • hosting provider failure
  • cyberattack
  • administrative decision
  • failure of an external service provider

Events considered force majeure include, but are not limited to:

  • natural disasters
  • fires
  • floods
  • pandemics
  • armed conflicts
  • terrorist acts
  • governmental decisions
  • large-scale Internet outages
  • hosting provider failure
  • payment provider interruption
  • exceptional cyberattacks
  • failure of a third-party service essential to the operation of the platform

Article 19 — Modification of the Terms

Any modification applies only to new orders.

Contracts already concluded remain governed by the version accepted at the time of purchase.

Article 20 — Evidence

Computerized records stored in the Publisher’s systems constitute valid proof of transactions.

Acceptance of the Terms is recorded with:

  • server timestamp
  • IP address
  • exact version of the Terms
  • user identifier

Article 21 — Refusal of Order

The Publisher reserves the right to refuse any order in the event of obvious fraud or payment irregularity.

Article 22 — Partial Invalidity

If any clause is declared invalid, the remaining provisions shall remain applicable.

Article 24 — Applicable Law

These Terms are governed by French law.

The competent courts shall be determined in accordance with the applicable legal rules.
